Important: Please read these rules before entering this contest (the “Contest”). By participating in this Contest, either by entering or accepting a prize, you agree to be bound by these Official Rules and represent that you satisfy all of the eligibility requirements below
OFFICIAL RULES – CONTEST
These are the Official Rules for JayWay Travel, Inc.’s #LoveJayWay Social Media Contest. The contest is administered and sponsored by JayWay Travel, Inc.
ELIGIBILITY
The Contest is open only to past and present clients of JayWay Travel, who are 18 years of age or older. Current employees, friends and family members of the judging panel are disqualified from entry.
HOW TO ENTER
To enter, follow the steps below:
FaceBook/Instagram/TikTok (a total of 2 Winners per month across all social networks):
- Make a permanent (not transient ‘story’ type post) on one of the above
- Tag @jaywaytravel in the post using the tagging tools provided by the platform
- Use the competition hashtag #LoveJayWay in the post description (tagging @jaywaytravel in the description is also highly recommended)
- Follow @jaywaytravel profile on the social media site in question
The Contest Periods are
- September 1 – 30, 2022
- October 1 – 31, 2022
- November 1 – 30, 2022
- December 1 – 31, 2022
Limit (1) entry in the Contest (prize defined below), per person on each social media account during each Contest Period. Multiple entries on one account will not be accepted. If an entrant is already following either the Instagram or Facebook page, they may still enter by following the rest of the entry rules.
RESULTS
Winners of the Prizes will be selected within one week (7 days) of the end of each prize period.
Winners will be notified privately via direct message on Instagram within 24 hours of the decision and Winners Winners will be notified privately via direct message on the social media platform they participated on (Instagram/TikTok/Facebook) within 24 hours of the decision and Winners will be required to provide their email address and address of residence (to verify their eligibility to win the prize, see Eligibility above) . Once winners have been notified, JayWay Travel will announce winners publicly by declaring so in the comment sections of the winning posts & tagging the Winners in re-posts of the winning posts. If a Prize winner is not eligible to win, or if the prize is not claimed within 72 hours, the prize will be forfeited, and an alternate winner may be selected.
PRIZE
The Prize: A virtual Prepaid Mastercard Gift card of $100 (USD)
Prize winners are responsible for any expenses incurred in connection with the prizes. No substitution or transfer of prizes is permitted, except that the Promotion Entities reserve the right to substitute a prize of equal or greater value, in the event that an offered prize is unavailable. All federal, state and local taxes on prizes are the sole responsibility of the winner. Prize details not set forth herein are the sole discretion of the Promotion Entities.
If requested, winners must execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within three days of notification. Failure to do so may result in disqualification, forfeiture, or award to an alternate winner.
RELEASE
By receipt of any prize, the winner agrees to release and hold harmless JayWay Travel, Inc., and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s shareholders, officers, directors, employees, members, assigns and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
GENERAL RULES
The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram, TikTok or Facebook.
Contests are governed by and subject to the laws of the United States and the state of New York.
All federal, state and local laws and regulations apply. Void where prohibited by law. By participating in a Contest and/or accepting any prize, entrants grant the Contest Entities permission to use their name, likenesses, and image in connection with the Contest for purposes of advertising, publicity, and promotion purposes, including, but not limited to, tagging the entrant on Instagram or Facebook, without further compensation to the entrant, unless prohibited by law. Entrants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding on all matters relating to Contests. The Contest Judges are not responsible for any typographical or other errors in the printing of the offer, administration of Contests or the announcement of the prizes, or for lost, late, misdirected, damaged, incomplete, or illegal entries.
The Contest Judges reserve the right at their sole discretion to disqualify any entrant found to be (a) tampering or attempting to tamper with the entry process or (b) violating the Official Rules.
JayWay Travel, Inc., will not be responsible for lost, incomplete, illegible, late, misdirected, stolen, or mutilated entries; technical or mechanical malfunctions; errors in the Official Rules, in any related ads or materials; or processing error. JayWay Travel will not share any personal information with third-party vendors and can void the entry of any entrant who it believes has attempted to tamper with or impair Contest administration, security, fairness, or proper play.
DISPUTES/GOVERNING LAW
Except where prohibited, as a condition of participating in Contests, entrant agrees that any and all disputes that cannot be resolved between the parties, and all claims and causes of action arising out of or connected with the Contest or any prize awarded, or the determination of winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, and entrant further waives all rights to have damages multiplied or increased.
All issues and questions rights and obligations of the entrant in connection with Contests shall be governed by, and construed in accordance with, the laws of New York, without giving effect to the conflict of laws rules thereof.
